Welcome to Kiki Clay Club at Mud & Wick LLC

Kiki Clay Club is more than a pottery studio. It is a creative community built around curiosity, craftsmanship, kindness, and respect. Our members come here to slow down, make things with their hands, develop new skills, and enjoy the company of other people who love working with clay. To make that experience possible, every member shares responsibility for maintaining a safe, clean, welcoming, and respectful studio.

This Agreement explains how membership works, what you can expect from us, what we expect from you, and the legal terms that apply whenever you participate in studio activities.

Please read this Agreement carefully before purchasing a membership, attending a class, reserving studio time, or using any Kiki Clay Club / Mud and Wick LLC facilities.

By purchasing a membership, checking an electronic acceptance box, signing this Agreement, making a reservation, attending the Studio, participating in any activity, or otherwise using the Studio, you acknowledge that you have read, understood, and agreed to be bound by this Agreement.

1. Definitions

Throughout this Agreement:
"Studio" means Mud & Wick LLC, doing business as Mud and Wick Ceramics including its owners, employees, instructors, volunteers, contractors, agents, and authorized representatives.

"Member" means the individual accepting this Agreement.

"Membership" means the access privileges purchased by the Member, together with any benefits associated with the selected membership level.

"Studio Activities" include, without limitation:

Open Studio sessions
Classes
Workshops
Demonstrations
Community events
Pottery making
Glazing
Kiln use
Equipment use
Clay preparation
Cleanup
Any activity occurring on Studio property or under Studio supervision.

2. Our Philosophy

Kiki Clay Club was intentionally designed to be different from a traditional production pottery studio. Our focus is not on fitting as many people into the building as possible. Instead, we are focusing on creating a welcoming, supportive creative environment and social group for our LGBTQ+ community and friends. We intentionally limit membership, require reservations, and build our programs around creating a relaxed, welcoming experience where members have room to work, learn, and connect. Every member contributes to this environment by treating others with kindness, respecting shared equipment, cleaning up after themselves, and helping preserve the atmosphere that makes Kiki Clay Club special. Membership is a privilege, not simply a transaction.

3. Membership Eligibility

Membership is available to adults who are at least eighteen (18) years of age unless the Studio expressly approves another arrangement in writing.
Membership is personal to the individual Member and may not be transferred, assigned, shared, loaned, or sold to another person.
Only Members in good standing may use Studio facilities during member hours unless the Studio has expressly authorized another form of participation.
Guests, visitors, minors, or other non-members may enter designated areas only with Studio approval and only after completing any required waivers or agreements.
The Studio reserves the right to deny or revoke membership whenever necessary to protect the safety, operations, or community of the Studio.

4. Membership Levels

Kiki Clay Club offers several membership options designed for different levels of participation.
Current membership levels, pricing, included reservation hours, storage allocations, discounts, and member benefits are published on the Studio website and may be updated from time to time.
Membership benefits are determined solely by the membership level purchased.
Members may use only those tools, equipment, supplies, storage areas, and services included with their membership unless additional access has been purchased or specifically approved by the Studio.
Using equipment or services outside the Member's level may result in additional charges, temporary suspension of privileges, or modification of the Member's membership level.
If a Member is uncertain whether a particular resource is included, they should ask Studio staff before using it.

5. Reservations and Studio Access

Because Kiki Clay Club intentionally limits occupancy to provide an enjoyable experience, nearly all Studio access is managed through reservations.
Members agree to reserve work time using the Studio's reservation system and to honor those reservations.
Members should arrive prepared to begin working at the scheduled reservation time and should leave their workspace clean and ready for the next member before their reservation ends.
If a reservation can no longer be used, Members are expected to cancel it as early as possible so another member may enjoy that time. A minimum of two hours prior to the start of the reservation is required for a cancellation.
If you no-show for your reservation, and have not cancelled two hours prior to the start of that reservation, your studio reservation hour bank will be reduced by the amount of the reservation time.
Repeated no-shows or repeated late cancellations may result in reservation restrictions, fees, suspension of reservation privileges, or termination of membership.
The Studio may establish additional reservation policies, cancellation windows, or waitlist procedures from time to time.

6. Membership Fees, Billing, and Automatic Renewal

Memberships are offered on a recurring monthly or annual basis unless otherwise stated at the time of enrollment.
By purchasing a membership, you authorize Kiki Clay Club to charge the payment method you provide for all recurring membership fees, applicable taxes, and any additional charges you authorize or incur under this Agreement. These may include, without limitation, purchases of clay, specialty materials, workshops, guest passes, replacement charges, cleaning fees, damage assessments, or other approved Studio services.
Membership fees are earned when billed and reserve your place within our limited membership community. Because membership capacity is intentionally limited, your monthly dues secure ongoing access to the Studio regardless of how frequently you choose to visit.
It is your responsibility to maintain a valid payment method. If a payment cannot be processed, the Studio may suspend access to reservations, storage, firing services, or other membership benefits until the account has been brought current.
From time to time, the Studio may revise membership pricing, benefits, operating hours, reservation policies, or other membership features. When required by applicable law, advance notice will be provided before changes affecting future billing become effective.

7. Membership Changes and Cancellation

We hope you'll remain part of the Kiki Clay Club community for many years. If your circumstances change, you may cancel your membership at any time in accordance with the Studio's current cancellation policy.
Cancellation requests must be submitted using the cancellation method designated by the Studio. Verbal conversations, text messages, social media messages, or informal conversations with instructors or staff do not constitute notice of cancellation unless the Studio expressly confirms the request in writing.
To avoid renewal for the following billing period, cancellation requests must be received before the published cancellation deadline associated with your membership.
Because membership capacity is limited and reserved specifically for each Member, membership fees are generally non-refundable once a billing period has begun, except where required by law.
From time to time, the Studio may choose to extend a courtesy credit or make an exception. Any such accommodation is voluntary and does not establish an obligation to provide similar exceptions in the future.

8. Reservations and Shared Studio Resources

Kiki Clay Club operates by reservation to ensure that every Member has access to equipment and workspace without overcrowding.
Reservation times should be treated with the same courtesy as appointments. If you reserve time, we ask that you either attend or release the reservation promptly so another Member may use it. Reservations must be cancelled 2 hours prior to the scheduled start time.

Members are expected to:

Arrive on time for reservations.
Vacate workstations at the scheduled end of their reservation.
Leave the workspace ready for the next Member.
Cancel reservations they cannot use.
Respect reservation limits established for their membership level.

Repeated no-shows, excessive late cancellations, or patterns of reserving time without using it may result in temporary reservation restrictions, administrative fees, suspension of reservation privileges, or termination of membership.

Our goal is fairness, not punishment. Reservation policies exist so every Member has a reasonable opportunity to enjoy the Studio.

9. Clay, Materials, and Firing Services

The Studio carefully selects the clay bodies, glazes, and firing processes used within the community in order to maintain consistent results and protect Studio equipment.
Unless the Studio provides written approval, Members may use only clay, glazes, firing materials, and chemical products authorized by the Studio.
The purchase price of Studio clay includes standard bisque and glaze firing unless otherwise noted. Specialty firings, oversized work, special materials, or unusual projects may require additional fees.
The Studio reserves the right to refuse to fire any work that, in its reasonable judgment, may present a risk to Studio equipment, kiln shelves, other Members' work, or the firing process itself. Examples include work that is excessively wet, improperly constructed, contaminated, made from unauthorized materials, or otherwise unsuitable for firing.
Members are responsible for following all posted guidelines regarding clay preparation, glazing, drying, labeling, and submission for firing.

10. Our Shared Studio

One of the things that makes Kiki Clay Club special is that the Studio belongs to all of us while we're here. Every Member shares responsibility for maintaining an environment that is clean, safe, welcoming, and enjoyable.

We ask every Member to:

Clean all tools and equipment after use.
Return shared tools to their designated locations.
Respect another Member's workspace and artwork.
Help reduce clay dust by following Studio cleaning procedures.
Report damaged equipment or unsafe conditions promptly.
Treat Studio property with the same care they would expect others to show their own work.

Our expectation is simple:

Leave the Studio a little better than you found it.
This philosophy is one of the foundations of our community and helps ensure that everyone enjoys working in a clean, organized, and inspiring environment.

11. Health, Safety, and Personal Responsibility

The Studio is committed to providing a safe environment for creativity and learning. Safety, however, depends on the shared responsibility of every person who enters the Studio. By participating in Studio Activities, you acknowledge that you are responsible for determining whether you are physically, mentally, and medically able to participate safely.

You agree to:

Follow all posted safety procedures, Studio policies, and staff instructions.
Use tools and equipment only for their intended purposes.
Complete any required orientation or training before using specialized equipment or materials.
Immediately report unsafe conditions, damaged equipment, spills, or accidents to Studio staff.
Exercise reasonable care for your own safety and the safety of others.

You also agree not to participate in Studio Activities while impaired by alcohol, illegal drugs, prescription medication that affects your ability to participate safely, illness, or any other condition that could create an unreasonable risk to yourself or others.

The Studio may deny participation or require a Member to leave if staff reasonably believe continued participation presents a safety concern.

12. Clay Dust and Respiratory Safety

Working with ceramics involves naturally occurring materials that require thoughtful handling.
Members acknowledge that clay and glaze materials may contain crystalline silica and other substances that can become hazardous when airborne.
To reduce these risks, Members agree to follow all Studio procedures regarding dust control, including wet-cleaning methods, proper disposal of clay waste, and restrictions on sanding, sweeping, grinding, or handling dry clay or glaze materials except as specifically authorized.
The Studio may recommend or require the use of appropriate personal protective equipment for certain activities.
Unless otherwise provided by the Studio, each Member is responsible for obtaining and properly using any recommended protective equipment.
Protecting our air quality is a shared responsibility that benefits every Member of the community.

13. Assumption of Risk

Ceramics is an inherently hands-on activity involving specialized equipment, high temperatures, chemicals, sharp tools, heavy materials, and other conditions that cannot eliminate all risk. By participating in Studio Activities, you knowingly and voluntarily accept these risks.

Potential risks include, but are not limited to:

Cuts, punctures, abrasions, and lacerations from pottery tools or broken ceramics.
Burns from kilns, hot pottery, heated equipment, wax, or firing processes.
Slips, trips, and falls caused by wet floors, clay, tools, electrical cords, shelving, or other studio conditions.
Injuries associated with pottery wheels, slab rollers, extruders, hand tools, carts, shelving, and other equipment.
Exposure to clay dust, silica, glaze ingredients, stains, oxides, cleaning products, smoke, or other substances that may affect respiratory, skin, or eye health.
Muscle strain, repetitive motion injuries, lifting injuries, or aggravation of pre-existing medical conditions.
Damage to personal clothing, footwear, tools, electronics, vehicles, or other personal property.
Injury resulting from the actions of other participants or unforeseen conditions within the Studio.

This list is intended as an illustration rather than a complete description of every possible hazard.

You understand that other known and unknown risks may exist, including risks that cannot reasonably be anticipated.

By choosing to participate despite these risks, you voluntarily assume full responsibility for your participation and for any resulting injury, illness, loss, or damage.

14. Release of Liability

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

To the fullest extent permitted by California law, you voluntarily release and discharge Mud & Wick LLC, doing business as Kiki Clay Club, together with its owners, officers, managers, employees, instructors, contractors, volunteers, landlords, affiliates, successors, assigns, and agents (collectively, the "Released Parties") from any claim, demand, cause of action, liability, loss, damage, or expense arising out of or relating to your participation in Studio Activities, use of Studio facilities or equipment, attendance at classes or events, or presence on Studio property.

This release includes claims arising from the ordinary negligence of the Released Parties to the maximum extent permitted under applicable law.
Nothing in this Agreement releases liability for conduct that cannot legally be released under California law, including gross negligence, willful misconduct, or other claims that applicable law prohibits from being waived.
By accepting this Agreement, you acknowledge that you understand you are giving up important legal rights, including the right to bring certain legal claims against the Released Parties.

15. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, liabilities, judgments, costs, or expenses, including reasonable attorneys' fees, arising out of or related to:

Your violation of this Agreement or Studio policies;
Your negligent, reckless, or intentional conduct;
Damage to Studio property or the property of another person;
Injury caused to another participant through your actions or omissions;
Unauthorized use of Studio equipment or materials; or
Claims brought by any guest or other person you invite into the Studio.

This obligation survives the termination of your membership.

16. Medical Emergencies

If Studio staff reasonably believe you require emergency medical assistance, you authorize the Studio to contact emergency responders, seek emergency medical treatment on your behalf, and notify your designated emergency contact if one has been provided.
You understand that Studio personnel are not medical professionals and are not responsible for determining whether medical treatment is necessary.
You remain solely responsible for all medical expenses, transportation costs, insurance deductibles, and related charges arising from any injury or illness.

17. Respect for the Studio, Artwork, and Shared Equipment

Kiki Clay Club is built on mutual trust. Every Member shares responsibility for protecting the Studio, respecting fellow artists, and caring for the equipment that makes our community possible.
Members are expected to use Studio equipment thoughtfully and only for its intended purpose.
No Member may intentionally or carelessly damage Studio property, alter equipment, misuse tools, contaminate materials, or interfere with another Member's work.
Likewise, Members may not handle, trim, glaze, move, photograph for commercial purposes, discard, or otherwise alter another person's artwork or personal property without that person's permission.
If damage occurs, notify Studio staff immediately. Honest mistakes happen. Prompt communication allows us to resolve problems fairly and often prevents additional damage.
Members remain financially responsible for damage resulting from negligence, misuse, intentional misconduct, unauthorized use of equipment, or violation of Studio policies. This may include repair costs, replacement costs, cleanup expenses, labor, damaged materials, or damage to another Member's work.
Normal wear resulting from appropriate use of Studio equipment is expected and will never be charged to Members.

18. Storage, Shelves, and Personal Property

Storage space is provided as a convenience and, for many membership levels, as a benefit of membership.
Assigned shelves remain the property of the Studio and may be used only by the Member to whom they are assigned.
Members are responsible for labeling their work and maintaining their assigned storage areas in an organized condition.
The Studio cannot guarantee the security or condition of personal belongings left on the premises. Members are responsible for their own tools, artwork, clothing, electronics, vehicles, and other personal property.
If a membership ends, Members are expected to remove all personal belongings, tools, clay, and artwork within the time period established by Studio policy.
Items remaining beyond that period may be considered abandoned and may be donated, recycled, discarded, or otherwise disposed of in accordance with applicable law.
Whenever practical, the Studio will attempt to notify Members before disposing of abandoned property; however, Members remain responsible for retrieving their belongings within the published deadline.

19. Ceramics Is Beautiful... and Unpredictable

One of the first lessons every potter learns is that clay has a mind of its own.
Drying, glazing, and firing are part science and part art. Even experienced ceramic artists occasionally lose work to cracking, warping, glaze defects, kiln accidents, hidden air pockets, thermal shock, or other conditions that cannot always be predicted or prevented.
By choosing to work with clay, Members acknowledge and accept these realities.
The Studio does not guarantee that any particular piece will survive drying, firing, glazing, handling, storage, transportation, or display.
Similarly, the Studio cannot guarantee specific glaze colors, surface finishes, firing schedules, completion dates, artistic outcomes, or delivery timelines.
Although we handle every piece with care, Members understand that artwork may occasionally be damaged through normal Studio operations, kiln loading, handling, storage, or the inherent uncertainties of ceramics.
Except where required by law or where the Studio expressly agrees otherwise in writing, Members assume these risks as part of participating in the ceramic arts.

20. Community Standards

The Culture We Protect: Kiki Clay Club exists because people deserve a place where creativity feels safe. We believe great studios are built not only by talented artists but by generous, respectful people who enjoy making alongside others.Every Member contributes to that culture.

We ask every Member to:

Treat others with kindness and respect.
Celebrate curiosity rather than perfection.
Offer encouragement freely.
Respect personal boundaries.
Welcome beginners.
Care for shared spaces.
Leave room for others to learn & Help create a calm, inclusive atmosphere.

Because Kiki Clay Club proudly serves the LGBTQ+ community and our friends, we expect every Member to help maintain an environment where:

All people are treated with dignity and respect regardless of sexual orientation, gender identity, gender expression, race, ethnicity, age, disability, religion, or background.
Discrimination, harassment, intimidation, bullying, retaliation, unwanted physical contact, threats, abusive language, or behavior that creates an unsafe or hostile environment has no place in our Studio.
Likewise, persistent disruption, dishonesty, repeated disregard for Studio policies, or conduct that undermines the experience of other Members may result in disciplinary action, including suspension or termination of membership.
Our goal is not simply to enforce rules, it is to preserve the kind of creative community that people look forward to coming back to each week.

21. Membership Suspension and Termination

Membership at Kiki Clay Club is intended to be a long-term relationship built on trust, mutual respect, and shared responsibility.
While we hope disciplinary action is never necessary, the Studio reserves the right to suspend, restrict, or terminate membership whenever reasonably necessary to protect the safety of Members, preserve the Studio environment, safeguard Studio property, or enforce this Agreement.

Examples of conduct that may result in suspension or termination include, but are not limited to:

Failure to comply with this Agreement or Studio policies.
Non-payment of membership fees or other amounts owed.
Misuse of Studio equipment or facilities.
Damage to Studio property or another Member's work.
Repeated failure to follow safety procedures.
Harassment, discrimination, threats, intimidation, or abusive behavior.
Conduct that materially disrupts Studio operations or negatively affects the experience of other Members.
Unauthorized use of Studio materials or facilities.
Bringing unauthorized guests into restricted areas.
Any conduct the Studio reasonably determines is incompatible with maintaining a safe and respectful community.

Whenever appropriate, the Studio may choose to address concerns through conversation, coaching, or written warnings before taking disciplinary action. However, the Studio may immediately suspend or terminate membership without prior warning whenever circumstances reasonably require immediate action to protect people, property, or Studio operations. Termination for violation of this Agreement does not entitle the Member to a refund except where required by applicable law.

22. Photography, Video, and Media

From time to time, photographs or video recordings may be taken during classes, workshops, community events, demonstrations, or other Studio Activities.
Unless you notify the Studio in writing that you prefer not to appear in promotional materials, you grant the Studio permission to use photographs or video in which you may appear for educational, promotional, marketing, social media, website, or archival purposes without additional compensation.
This permission includes the right to edit, reproduce, publish, and distribute such materials in any media now known or later developed.
You may withdraw this consent at any time for future uses by providing written notice to the Studio. Withdrawal will not affect materials already published or distributed before notice was received.
The Studio will make reasonable efforts to honor Members' privacy preferences and will never intentionally identify a Member by name in promotional materials without permission unless the Member has already publicly associated themselves with the Studio.

23. Changes to Policies and Membership Terms

Like any living community, Kiki Clay Club will continue to evolve.
The Studio may periodically update membership benefits, Studio policies, operating procedures, reservation rules, pricing, safety requirements, or other operational matters in order to improve the Member experience or respond to changing business needs.
Material changes affecting legal rights or recurring billing will be communicated as required by applicable law.
Your continued participation in Studio Activities after receiving notice of non-material policy updates constitutes acceptance of those updated policies.
If you do not agree with a material change to this Agreement, your remedy is to discontinue participation and cancel your membership in accordance with the cancellation policy.

24. Dispute Resolution and Governing Law

This Agreement shall be governed by the laws of the State of California without regard to its conflict of law principles.
The parties agree to make a good-faith effort to resolve any disagreement through direct communication before pursuing formal legal action.
If a dispute cannot be resolved informally, the parties agree to participate in mediation before filing suit, unless immediate court action is necessary to protect legal rights or property.
Unless otherwise required by law, any legal proceeding arising from this Agreement shall be brought in a court of competent jurisdiction located in Riverside County, California.
The prevailing party in any action to enforce this Agreement may recover reasonable attorneys' fees and costs if permitted by applicable law or contract.

25. General Legal Provisions

Entire Agreement

This Agreement constitutes the complete understanding between the Member and the Studio regarding membership and participation in Studio Activities and supersedes all prior discussions, representations, or agreements concerning those subjects.

Severability

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver

A failure by the Studio to enforce any provision of this Agreement on one occasion does not waive the Studio's right to enforce that provision or any other provision in the future.

Electronic Acceptance

Electronic signatures, electronic acknowledgements, and online acceptance of this Agreement have the same legal force and effect as handwritten signatures.

Headings

Section headings are included solely for convenience and do not affect the interpretation of this Agreement.

Member Acknowledgements

By accepting this Agreement, I acknowledge that:

☐ I understand that pottery and ceramics involve inherent risks.

☐ I voluntarily assume those risks.

☐ I understand that I am releasing certain legal claims against the Studio as described in this Agreement.

☐ I agree to follow Studio policies and safety procedures.

☐ I understand that membership fees are recurring until canceled according to the Studio's cancellation policy.

☐ I understand that ceramic work may break, crack, warp, or otherwise fail during normal Studio processes and that such losses are part of working with clay.

☐ I understand that Kiki Clay Club is a private membership community and that maintaining a respectful, welcoming environment is a condition of membership.

It is your responsibility to maintain a valid payment method. If a payment cannot be processed, the Studio may suspend access to reservations, storage, firing services, or other membership benefits until the account has been brought current.

From time to time, the Studio may revise membership pricing, benefits, operating hours, reservation policies, or other membership features. When required by applicable law, advance notice will be provided before changes affecting future billing become effective.

7. Membership Changes and Cancellation

We hope you'll remain part of the Kiki Clay Club community for many years. If your circumstances change, you may cancel your membership at any time in accordance with the Studio's current cancellation policy.

To avoid renewal for the following billing period, cancellation requests must be received before the published cancellation deadline associated with your membership.

Because membership capacity is limited and reserved specifically for each Member, membership fees are generally non-refundable once a billing period has begun, except where required by law.

From time to time, the Studio may choose to extend a courtesy credit or make an exception. Any such accommodation is voluntary and does not establish an obligation to provide similar exceptions in the future.

8. Reservations and Shared Studio Resources

Kiki Clay Club operates by reservation to ensure that every Member has access to equipment and workspace without overcrowding.

Reservation times should be treated with the same courtesy as appointments. If you reserve time, we ask that you either attend or release the reservation promptly so another Member may use it. Reservations must be cancelled 2 hours prior to the scheduled start time.

Members are expected to:

Arrive on time for reservations.

Vacate workstations at the scheduled end of their reservation.

Leave the workspace ready for the next Member.

Cancel reservations they cannot use.

Respect reservation limits established for their membership level.

Repeated no-shows, excessive late cancellations, or patterns of reserving time without using it may result in temporary reservation restrictions, administrative fees, suspension of reservation privileges, or termination of membership.

Our goal is fairness, not punishment. Reservation policies exist so every Member has a reasonable opportunity to enjoy the Studio.

9. Clay, Materials, and Firing Services

The Studio carefully selects the clay bodies, glazes, and firing processes used within the community in order to maintain consistent results and protect Studio equipment.

Unless the Studio provides written approval, Members may use only clay, glazes, firing materials, and chemical products authorized by the Studio.

The purchase price of Studio clay includes standard bisque and glaze firing unless otherwise noted. Specialty firings, oversized work, special materials, or unusual projects may require additional fees.

Members are responsible for following all posted guidelines regarding clay preparation, glazing, drying, labeling, and submission for firing.

10. Our Shared Studio

One of the things that makes Kiki Clay Club special is that the Studio belongs to all of us while we're here. Every Member shares responsibility for maintaining an environment that is clean, safe, welcoming, and enjoyable.

We ask every Member to:

Clean all tools and equipment after use.

Return shared tools to their designated locations.

Respect another Member's workspace and artwork.

Help reduce clay dust by following Studio cleaning procedures.

Report damaged equipment or unsafe conditions promptly.

Treat Studio property with the same care they would expect others to show their own work.

Our expectation is simple:

Leave the Studio a little better than you found it.

Throughout this Agreement:
"Studio" means Mud & Wick LLC, doing business as Mud and Wick Ceramics including its owners, employees, instructors, volunteers, contractors, agents, and authorized representatives.

Membership is available to adults who are at least eighteen (18) years of age unless the Studio expressly approves another arrangement in writing.
Membership is personal to the individual Member and may not be transferred, assigned, shared, loaned, or sold to another person.

Kiki Clay Club offers several membership options designed for different levels of participation.
Current membership levels, pricing, included reservation hours, storage allocations, discounts, and member benefits are published on the Studio website and may be updated from time to time.
